Stately Driveways Director Sentenced

A rogue trader has been sentenced under the Consumer Protection from Unfair Trading Regulations 2008 for using aggressive trading practices. Trading Standards found they had pressurised Scarborough and Malton residents to agree to have driveway work done which they didn’t need.

Following an investigation by North Yorkshire County Council Trading Standards, they found that David Welch, along with his company, Stately Driveways, made repeated visits to residents during the same day, told residents he would take them to the bank to obtain payment and to see other driveways he had worked on.

After he carried out the work, he failed to respond to phone calls from residents when their driveways began to fail. To make matters worse, the company used a false address on their business flyers, which meant many customers couldn’t make contact through writing, either.  

Aggressive sales tactics

One Scarborough resident was put under pressure by David Welch to have their existing block paved driveway replaced and one couple made 75 calls to David Welch to try to secure a repair for their driveway but were unsuccessful. 

David Welch was convicted at Scarborough Magistrates’ Court and was given a conditional discharge for three years, was fined £10,000 for his offences and was ordered to pay compensation totalling £16,000 to his former customers.

County Councillor Chris Metcalfe, the Executive Member for Trading Standards, said: “I am delighted that the court recognised the severity of David Welch’s action in sentencing him. I hope that this case sends a message that rogue traders are not welcome in North Yorkshire and our trading standards team will do all it can to protect our residents from unfair and aggressive trading.”
